Conflicto de competencia suscitado entre el Juzgado Segundo Penal Municipal para Adolescentes con Funciones de Control de Garantías de Pasto y el Juzgado Primero Laboral del Circuito de la misma ciudad.
Considera la Corte que la discusión planteada por los despachos judiciales involucrados se amparó únicamente en las reglas de reparto del Decreto 1382 de 2000 y que la primera autoridad a quien se le repartió el expediente, al determinar en forma a priori quien debía ser el demandado, asumió atribuciones que no le correspondían.
Se dirime el asunto con la remisión del expediente al Juzgado de categoría municipal, para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
